1. Access to the Platform
1.1 Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms to use the Platform.
1.2 Account Registration
To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account.
1.3 Accuracy of Information
You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.
2. Intellectual Property
2.1 Ownership
The Company or its licensors own all content, materials, and intellectual property rights on the Platform, with the exception of YouTube videos presented. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Platform without prior written permission from the Company.
2.2 User Content
By submitting or posting any content on the Platform, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such content in connection with the Platform.
3. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
- Impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity.
- Interfere with or disrupt the integrity or performance of the Platform or its related systems.
- Attempt to gain unauthorized access to the Platform or its related systems.
- Engage in any form of data mining, scraping, or similar data extraction or gathering activities.
- Upload or transmit any viruses, worms, or other malicious code to the Platform.
- Harass, intimidate, or otherwise violate the rights of others, including their privacy rights.
4. Disclaimer of Warranties
The Platform is provided on an "as-is" and "as-available" basis. The Company makes no warranties or representations, whether express or implied, regarding the accuracy, reliability, or completeness of the Platform. Your use of the Platform is at your sole risk.
5. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses arising out of or in connection with your use of the Platform.
6. Modifications to the Terms
The Company reserves the right to modify or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for any changes. Continued use of the Platform after any modifications constitutes your acceptance of the revised Terms.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the province of British Columbia, Canada. Any dispute arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
8. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
